1. Acceptance of This Policy
By purchasing, activating, or using our services, submitting the initial activation payment, providing a payment method, or accepting leads from us, the customer confirms that they have read, understood, and agreed to this Refund and Cancellation Policy.
This Policy forms part of the agreement between the customer and Pay When It Works.
2. Initial Activation Payment
Customers may be required to make an initial payment of $1.00 USD to activate the service, confirm their payment method, and authorize the start of lead-generation campaigns.
The $1.00 activation payment is final and nonrefundable to the fullest extent permitted by law.
4. All Payments Are Final
To the fullest extent permitted by applicable law, all payments made to Pay When It Works are final, noncancelable, and nonrefundable.
Pay When It Works does not provide cash refunds, partial refunds, prorated refunds, or refunds based on dissatisfaction with a lead or the results produced from a lead.
This no-refund policy applies to the initial activation payment and every charge associated with leads generated or delivered to the customer.
5. Definition and Delivery of a Lead
A lead consists of contact information that allows the customer to contact a person regarding the applicable service or offer.
Leads may be delivered through email, text message, or another delivery method selected by Pay When It Works.
A lead is considered delivered and fully billable when its contact information is sent to the email address, telephone number, account, or other destination provided or approved by the customer. The lead remains delivered even if the customer does not open, review, respond to, or use the information.
6. Lead Quality and Billability
The customer understands that a lead represents a potential contact and not a guaranteed customer, appointment, sale, or business opportunity.
Every delivered lead remains billable. A lead does not become eligible for a refund because:
- The person does not answer a call, email, or text.
- The person cannot be reached.
- The person changes their mind.
- The person does not respond after initially showing interest.
- The person does not schedule or attend an appointment.
- The person does not purchase the customer’s service.
- The person cannot afford or does not qualify for the service.
- The person provides inaccurate, incomplete, or outdated information.
- The customer has previously communicated with the person.
- The person speaks with or hires another provider.
- The person does not meet the customer’s expectations.
- The lead is outside the customer’s preferred location or service criteria.
- The lead requests a different service than expected.
- The lead is duplicated or was previously known to the customer.
- The customer fails to contact the lead promptly.
- The customer is dissatisfied with the lead for any other reason.
Pay When It Works does not guarantee the accuracy, completeness, intent, responsiveness, or purchasing ability of any lead.
7. No Guarantee of Results
Pay When It Works does not guarantee:
- A specific number or quality of leads
- Contact or response rates
- Appointments or appointment attendance
- Qualified prospects
- Sales or closed deals
- Revenue, profit, or return on investment
- Any other specific business result
The customer is solely responsible for contacting leads, following up, presenting their offer, determining suitability, complying with applicable laws, and attempting to convert leads into customers.
A customer’s inability or failure to achieve a desired result does not create a right to a refund, reversal, or cancellation of charges already incurred.
8. Billing Errors
If Pay When It Works verifies that it made a genuine billing error, such as processing the same charge twice or charging an amount that was not authorized, Pay When It Works may correct the issue by applying a credit to the customer’s account.
Account credits have no cash value and cannot be withdrawn, transferred, or exchanged for a cash refund.
If applicable law, payment-network rules, or a binding payment-processor decision requires a payment reversal instead of an account credit, Pay When It Works will comply with that requirement.
A disagreement concerning lead quality, responsiveness, conversion, or results is not considered a billing error.
9. No Retroactive Cancellation
Cancellation applies only to future campaign activity. Customers cannot cancel leads that were generated, acquired, processed, or delivered before Pay When It Works received their cancellation request.
All such leads remain billable, and the customer authorizes Pay When It Works to process any outstanding charges associated with them.
10. Cancellation and Opt-Out Requests
Customers may cancel future lead-generation activity by emailing:
support@paywhenitworks.com
Pay When It Works will stop active campaign outreach as soon as reasonably possible after receiving the cancellation request.
The customer remains responsible for:
- Leads delivered before the cancellation request was received
- Leads generated or acquired before the cancellation request was received
- Outstanding charges associated with prior campaign activity
- Charges already submitted for payment processing
Cancellation does not create a right to a refund or account credit.
11. Payment Disputes and Chargebacks
Customers are encouraged to contact Pay When It Works at support@paywhenitworks.com before filing a payment dispute or chargeback.
When permitted, customers should provide sufficient information for Pay When It Works to identify and review the transaction.
Pay When It Works may respond to disputes by providing the payment processor, card network, or financial institution with relevant records, including:
- Payment authorization records
- The payment-link description
- This Refund and Cancellation Policy
- Customer communications
- Lead-delivery records
- Campaign records
- Call recordings, where available
- Billing history
- Cancellation records
- Evidence showing that services were performed
A chargeback or payment dispute does not automatically cancel the customer’s outstanding contractual obligations. Pay When It Works reserves the right to suspend services and pursue lawfully due amounts, subject to applicable law and binding payment-network decisions.
Nothing in this section limits any dispute rights that cannot legally be waived.
12. Customer Responsibilities
The customer is responsible for:
- Providing accurate contact and billing information
- Maintaining a valid payment method
- Reviewing the payment terms before activating the service
- Monitoring lead deliveries and payment charges
- Informing Pay When It Works promptly of any verified billing error
- Using all lead information lawfully
- Complying with privacy, marketing, calling, emailing, texting, and consumer-protection laws
- Obtaining any consent required before contacting a lead
Pay When It Works is not responsible for how the customer uses lead information after delivery.
13. Mandatory Legal Rights
This Policy applies to the fullest extent permitted by law.
Nothing in this Policy excludes, restricts, or waives a customer right that cannot legally be excluded, restricted, or waived under applicable law. If a provision of this Policy conflicts with a mandatory law, that mandatory law will apply only to the extent of the conflict. The remaining provisions will continue in full force.
14. Changes to This Policy
Pay When It Works may update this Policy from time to time. Updates will apply prospectively from the date they are published.
The version in effect when a payment is authorized or a service is provided will govern that transaction unless applicable law requires otherwise.
15. Governing Law and Jurisdiction
This Policy is governed by the laws of France, without regard to conflict-of-law principles.
Subject to mandatory laws concerning jurisdiction and consumer rights, disputes relating to this Policy or the services provided by Pay When It Works will be submitted to the competent courts of France.
16. Contact Information
